By accessing or using the CollectaComic website (collectacomic.com), making any purchase from us (whether through our website, eBay, or any other platform), or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE OUR WEBSITE OR PURCHASE ANY PRODUCTS FROM US.

These Terms of Service constitute a legally binding agreement between you and CollectaComic, a business operating under the laws of the State of Tennessee, United States. You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

Description of Service

CollectaComic is an online platform for buying and selling professionally graded comic books. We sell comics through our website and third-party platforms including eBay. All comics sold are authenticated and graded by professional grading companies including CGC (Certified Guaranty Company), CBCS (Comic Book Certification Service), and PSA (Professional Sports Authenticator).

Product Information

We strive to provide accurate descriptions and images of all products. However:

• Colors and details may appear slightly different due to monitor settings and photography
• Grades are assigned by third-party grading companies, not by CollectaComic
• Minor cosmetic imperfections on slab cases are considered normal and do not affect the comic inside
• We recommend verifying certification numbers with the grading company before purchase

Pricing and Payment

All prices are listed in US Dollars (USD) unless otherwise specified. Prices are subject to change without notice.

• Payment must be received before items are shipped
• We accept payments through eBay's checkout system and other methods for direct sales
• Buyers are responsible for any applicable taxes, duties, or customs fees
• Prices do not include shipping unless explicitly stated

Shipping

• Orders typically ship within 1-2 business days
• Signature confirmation is required for insurance coverage
• Risk of loss transfers to the buyer upon delivery
• International shipping is available on select items

Returns and Refunds

All sales of graded comic books are considered final. Please review our complete Returns Policy before making a purchase. In summary:

• We generally do not accept returns or offer refunds
• Shipping damage claims are reviewed on a case-by-case basis
• Signature confirmation is required to be eligible for damage claims
• Damage must be documented immediately and reported within 48 hours

All content on this website, including text, graphics, logos, images, and software, is the property of CollectaComic or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission. Comic book characters and related imagery are the property of their respective publishers.

When purchasing from us through third-party platforms such as eBay, you are also subject to that platform's terms of service and buyer protection policies. In case of conflict between our terms and the platform's terms, the platform's policies may apply to transactions made through that platform.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE LAWS OF THE STATE OF TENNESSEE, COLLECTACOMIC, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Loss of data or goodwill
• Cost of procurement of substitute goods or services
• Personal injury or property damage
• Any other intangible losses

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF OUR WEBSITE, OR ANY PRODUCT PURCHASED FROM US EXCEED THE LESSER OF: (A) THE AMOUNT YOU ACTUALLY PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

THE LIMITATIONS SET FORTH IN THIS SECTION SHALL APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE, SERVICES, AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE
• WARRANTIES THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT

ALL GRADING ASSESSMENTS ARE MADE SOLELY BY INDEPENDENT THIRD-PARTY GRADING COMPANIES (CGC, CBCS, PSA). WE MAKE NO INDEPENDENT WARRANTY, REPRESENTATION, OR GUARANTEE REGARDING GRADES, AND ANY DISPUTES REGARDING GRADING MUST BE DIRECTED TO THE RESPECTIVE GRADING COMPANY. YOUR SOLE REMEDY FOR DISSATISFACTION WITH GRADING IS TO SUBMIT THE ITEM FOR RE-GRADING AT YOUR OWN EXPENSE.

Indemnification

You agree to indemnify, defend, and hold harmless CollectaComic, its owners, officers, directors, employees, agents, licensors, suppliers, and any third-party information providers from and against all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

• Your use or misuse of our website or services
• Your breach of these Terms of Service
• Your violation of any applicable law or regulation
• Your infringement of any intellectual property or other rights of any third party
• Any dispute between you and any third party regarding a transaction

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

Governing Law and Jurisdiction

These Terms of Service and any disputes arising out of or related to these terms, your use of our website, or any products purchased from us shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions.

You expressly agree that the exclusive jurisdiction and venue for any claim or action arising out of or relating to these Terms of Service or your use of our website or services shall be the state or federal courts located in the State of Tennessee, and you hereby submit to the personal jurisdiction of such courts and waive any objection based on venue or forum non conveniens.

Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution: Before initiating any formal dispute resolution, you agree to first contact us at contact@collectacomic.com to attempt to resolve any dispute informally. We will attempt to resolve the dispute within 30 days of receiving your notice.

Binding Arbitration: If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms of Service, or the breach thereof, shall be settled by binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the State of Tennessee. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver: YOU AND COLLECTACOMIC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Unless both you and CollectaComic agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits.

Waiver of Jury Trial

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND COLLECTACOMIC EACH WAIVE THE RIGHT TO A JURY TRIAL IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OF SERVICE OR THE TRANSACTIONS CONTEMPLATED HEREBY.

Time Limitation on Claims

You agree that any claim or cause of action arising out of or related to your use of our website, services, or products must be filed within ONE (1) YEAR after such claim or cause of action arose, or be forever barred. This limitation applies regardless of any statute or law to the contrary.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website after changes constitutes acceptance of the modified terms.

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and CollectaComic regarding your use of our website and services, and supersede all prior and contemporaneous agreements, proposals, representations, and understandings, whether written or oral, regarding such subject matter.

Assignment

You may not assign or transfer these Terms of Service or any rights or obligations hereunder without our prior written consent. We may assign these Terms of Service without restriction. These Terms of Service shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

No Waiver

Our failure to enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms of Service will be effective only if in writing and signed by CollectaComic.
